I have a 1841 census that shows the family living in Brixton which is where he married Anna. The census states that he was born in Surry, England. Also the same for his father. Obviously this could be wrong as many people could not read or write and therefore the information was written down by a third party and I know that information can be incorrect.

Hello Irene, the Merchant Navy record was from FindMyPast. Do note the note I put on that although it states he was born in Dorset, he lived in St Olave, Middlesex - I believe that's part of Southwark. The address on Joseph James' baptism was Southwark.

Where do you believe James Warr was actually born? Could you give details of any census you have him on.

Joseph James Warr 1845 - 1847 Address on baptism cert. Abdy St., Southwark occupation Sail Maker
Walter James Warr 1849. Know a lot about him as I am in contact with his granddaughter who has knowledge and documents passed to her. Walter also tried to find out what happened to his father.
William Warr 1852.

Samuel Fergus Stewart 1856. So somewhere between 1852 and 1855 James Warr goes missing. Sometimes John James Warr. I don't think James Warr was born in Dorset - so though it is intriguing I don't think the information is him. Though I would like to know where you found this. I also found a prison record for a James War (sailor) 1 year hard labour in Dorset - as there seemed to be a gap between marriage and child I thought maybe - but we can never be sure.

Thank you for all your contributions - there is some discrepancy about his age but I do notice that these things happen in many census'.

You are right and I believe Fergus William was in the army and moved around quite a bit even to Jersey.

Fergus was born in 1833 and was baptised in South London. He was with Anna in 1861 census in Tottenham. It appeared they ran a sort of pub - I have my great grandmother's birth cert and she was born there in 1859. There is no record of marriage though Anna called herself Stewart. She was married to James Warr prior to this and had two sons then had my great grandmother and another son names Emily Lavinia Stewart and Samuel Fergus Stewart. Within a few years he married Elizabeth Parr. What happened to James Warr? I am in contact with Anna's descendants who would love to know what happened to him. I have looked at every route possible and cannot find them in 1851 census which might give us some information. In fergus' death cert. he is attended by his son Alexander who would have been only 14 or so at the time. So strange that he was in Hampshire and the address has been a pub since the mid 1800's. He is definitely my most intriguing ancestor. Fergus Wiiliam was his son.

Irene, I notice that on Fergus' probate that administration was granted to his widow Elizabeth. I've had another look at those divorce papers and I don't think the divorce did actually go ahead. Proceedings were commenced 1886 but there is a note in 1887 that the cause be stayed - looks like Fergus didn't come up with the money for the costs. In 1888 there is a recording that the cause be struck off the lists for hearing.

So Elizabeth was still legally his wife so I guess he wasn't legally free to marry Anna (so he was a cad and a bounder but at least he wasn't a bigamist!) - I'm presuming Anna came after Elizabeth?

If you want give us some details on James Warr could take a look ......

EDIT: Looks like Anna was married to James in 1842 so must have been earlier

Yes you are right. He is a mystery to me as it seems he did not marry my great great grandmother and left her with two children - she in turn was married previously to a James Warr and what happened to him is also a mystery. I am unable to find any living descendants from his 'second' marriage as they might have known more about him!!

Hello Irene, must admit that my curiosity was piqued and I had a look at the divorce petition and the order for restitution of conjugal rights, how humiliating for his poor wife - certainly sounded like something was going on with that housekeeper.

Thank you so much one and all. I do have the will of Fergus in which he left his wife (whom brought the divorce petition) £90. I also have all the Census'. Thank you for the 1891 census. He was at 108 Spa Road in 1886 and was the master. It is very well explained in the divorce petition - by 1890 he died of tuberculosis in Shirley, Southampton. It would seem that someone took over and not any of his sons. I will add the 1891 census to my records.
