McAnne's Gahan-Crazy Report 1 Jul 2008 12:19

Ann yes he can unfortunately :O(

Company policy is you are paid at management discretion - up till now, MY boss has been happy to continue paying me - but HIS boss Area Director has told him no - only to get SSP ............

so i have no choice now but to return to work next week when my docs cert runs out, regardless

Nanna Gaynor (June nr Preston's Daughter) Report 1 Jul 2008 12:23

Yup... been there myself..

I started back to work 3 weeks ago after having 4 months off work with depression... I had been off for 6 weeks before Christmas too.
He paid me the first time but both times I have returned to work under duress. They put me under pressure and I know I am still not ready I am finding it very emotionally difficult.
My boss's boss, like yours, refused to pay me the second time and after a lot of pressure to return and almost depleting my savings in order to pay the bills, I have reluctantly and against my Dr's wishes, returned to work.
I am now also worrying that they will sack me on performance grounds (it's easy to biuld up a case that way and they wouldn't then be in trouble for finishing me whilst I was off sick either)

Thinking of you MacAnne.... take care and be kind to yourself... easier said than done in these circumstances

Hi - I'd check their policy with someone like ACAS - just because it's their policy doesn't mean it's lawfull - good luck :)

McAnne's Gahan-Crazy Report 1 Jul 2008 12:54

I signed a contract agreeing to their terms & conditions - so i have no case to fight!

I'm upset more at the insinuation that i am pulling a flanker !! when i have my arm in plaster !!

Gaynor i know what you are going thru - been there myself many years ago.

Anyway i don't know when this plaster is likely to come off, because i still don't know if i have a fracture - all i know is i cannot use my hand properly (right hand) and that when i try to it cause discomfort as i turning it awkwardly to use.

I shall make sure it is recorded that i have returned against medical advice but under duress, because as i said to my boss - if i DO have a fracture and i make it worse by overdoing things, that could affect me very considerably long term !!

PinkDiana Report 1 Jul 2008 13:06

Get the doctor to sign you back onto work on REDUCED hours - then they have no choice but to pay you!!

But they are GITS!!

AnninGlos Report 1 Jul 2008 13:09

Was it in the accident book Anita?

Definitely record it in writing that you are returning against medical advice. (suggest you could d the same Gaynor). What sort of bosses are these that don't care about their staff? I would make sure that things get knocked over etc with your plaster Anita!!!, maybe 'bump' into bosses boss with it and bruise his arm. maybe he will then see that you are a liability. You signed the contract, but that doesn't mean they are withing their rights to call you back when you are not fit for work.. I would seek further advice on that. show somebody at CAB or ACAS your contract.

That's diabolical - especially as you tried to struggle on when you first did it. Just shows - give bosses an inch and they'll take a mile!!
Bet if it was your Area Boss who had hurt their wrist, it would be a different matter.

McAnne's Gahan-Crazy Report 1 Jul 2008 13:56

Good idea Pink ...........

Ann - yes it was reported thru the official system

Maggie - the area boss is a flaming work-aholic ....... he couldn't even understand why my mate was looking forward to retirement. He's the sort that will die at his desk - sad g*t !!

Never liked him much anyway but have to tolerate him - now i won't even bother being politely friendly!!

Sheila Report 1 Jul 2008 14:23

Happened to me last year. I hurt my back and was told I would be off 4-6 weeks. I managed to get back in less than three, but back has not been right since.

Manager had discretion to pay me but said he would not! Said he couldn't afford to!

Then I had a hospital appointment and didn't get to work until 11.30 am. He insisted I took half a day's holiday, even though I had said I wouldn't take a lunch break so he'd only lost 1.5 hours of my work time.

No point raising a grievance as it would have been heard by him, so I just left.

He's still got his slaves in his office without proper facilities - good luck to them.

McAnne, don't roll over - your health comes first.

Did you injure yourself at work in the first place?

McAnne's Gahan-Crazy Report 1 Jul 2008 14:29

Hi Sheila

That is my concern - causing my hand not to heal correctly by overdoing things - IF my hand is fractured ........ still don't know but wearing a cast is still damned uncomfortable all the same lol

Yes i did do it at work, but it was no ones fault, just a freak accident could have happened anywhere at anytime - just a simple stumble up the stairs .............

They certainly don't know how to nuture staff commitment/loyalty do they ???

Meduck Report 1 Jul 2008 15:56

Just a thought. If you are in plaster, should they have you back at work under "Health and Safety grounds"

chrisa Report 1 Jul 2008 16:22

McAnne sorry I don't know your history but I just wanted to let you know a problem my sister had.

Is it your Scaphoid that the docs are querying the fracture?

If so you need to be very carefull. My sister fractured her Scaphoid 6 or 7 years ago now. She had problems with it healing. In the end it didn't heal properly & her ligaments were damaged.

She has now had two surgeries. She has a scar running the length of her forearm. She has had bone removed from her fore arm & a metal plate fusing her wrist.

If I were you I would be speaking to the doctor about being forced back to work & also to ACAS.

Thinking of you McAnne, my son had an accident at work, he was desperate to get back , and the work said if he cot a docs cert saying he could do light duties he could go back,so he got one and went back, then his work mate went off and he had to do heavy lifting which the work was willing to let him do,2 days later he had to go home as his injury was very painful, went back to doc who signed him off.they put him on ssp right away,he is fuming sent email after email and now he has a meeting tomorrow , fingers crossed he gets it sorted out . like everyone eles he has bills to pay and has started to fall behind.I think he should have put in a claim but he wont,......., think he might if things dont go well tomorrow.

are you going for compensation if you did it in work

AnninGlos

AnninGlos Report 1 Jul 2008 17:47

Don't think Anita would get compensation Julie Ann, it was not the fault of anyone, nothing dangerous to fall over as I remember.

however, not sure where they stand if damage is done by forcing her back to work before time.

McAnne's Gahan-Crazy Report 1 Jul 2008 18:12

Hello all

sorry been gone a couple of hours, had an appt.

Thanks for your comments ............ Yes it is my scaphoid and i know what probs can occur if it IS fractured and i don't take care :O(

And it's no to compensation - it was a freak accident whereby my trouser leg tripped me up lol

Also they are not forcing me to go back, but if i don't i will be losing money, i can barely manage on a full wage, so going onto SSP is not an option, therefore I have to go back to work.

They will argue that my financial situation is not their concern, so i am in a Catch22 situation ..............
