We have a 3 x g father called Wiliam Ware who was tried at Surrey Assizes in Mar 1841 and sentenced to 7 years transportation to Tasmania. We have seen the trial book and it does not help.
On his convict record he says his family name is Shute and elsewhere that his fsther was John Shute and he took the name Ware from his mother Mary Ann Clarke.

We believe this means he was most likely born illegitemate and his mother was born Mary Ann Clarke and Married a ? Ware after he was born.
He was born in Newington London in 1824 presumably as Wiliam Shute but was William Ware by the time of his trial in Mar 1841.
