Erika Thanks I have sent a message to the person on Ancestry but as yet no reply. Even if it is 1805 I am still not sure who the Jane is - but hopefully the person will reply sometime soon. Thanks

Looking at the state of that headstone, I do wonder whether the year of James's death has been misinterpreted. 8 and 5 are so similar...................

May 1805 would fit nicely with the Probate date

The person who posted the photo on Ancestry has the surname POOK - perhaps he has more info that could help Rose

Inscription on a gravestone (photo on ancestry)

In Loving Memory of Susanna Pook, who died April 17th 1795, Also of James, Husband of the above, Lost at sea May 1808. Also of Sarah Hurrell, Daughter of the above, And widow of Robert Holmes, of Rattery in the county, who died Jan. 28th 1885, Buried at Burnsall, Yorkshire, Aged 93 years.

Where did you get the info that Susanna's husband died in 1808?

Again thanks. The record is the same with the names but I hadn't seen the one that says"probate" so sounds right can't be before his death. The reference I had was ADM/48/73/100 in the wills of royal naval seaman date 8June 1805 but it didn't say probate. But with the names James and Jane it looks like it should be the same. If he died earlier than 1808 it is not the same one. However I can find another James Pook dying around 1805!

But that 1805 will says probate year 1805 Probate could not have been granted before his death

Erika- He died in 1808.
The will is a will made in the Navy in 1805 when he was serving on the Temerarie NOT when he died.

Your title gives 1808 as his death year - is this not accurate?

If it is - the 1805 death is irrelevant

Lancashire Ann - "My" James married Susanna Hurrell. She died in 1795. In a will for a James Pook dated 1805 when he was serving on the HMS Temeraire the bequeath was to " his wife Jane".
I had been told that My James had been on the HMS Orion and the Temerarie so wondered if he may have got remarried but could not find anything. I also could not find another potential James Pook married to a Jane who may have been on the Temeraire.
A will is shown when "my" james served on the HMS orion in 1798 , he gave everything to his brother Samuel- which seems correct.
It was more of a mystery to solve than essential and as we know Family History research gets confusing sometimes. Thanks to everyone for their help

is 'your' James the one who married Susannah or the one who married Jane?

Grey ghost yes I know that you aid two James Pook maybe and I had been looking at that option. I thought I would try and see if anyone could find a marriage between my James Pook and a Jane and I had not been able to. But unfortunately did not realise that I should have not started another thread on the Find Ancestors! All the information everyone has given me is great and I am still looking to see if I can find the solution. thanks everyone.

are you sure that 2nd will is the same James Pook? There were a few of them born in Devon about that time

He was buried with Susanna and named as her husband lost at sea in 1808. Also in the grave is Sarah Hurrell named as Susannah's daugter

Trying to find a second marriage for James Pook. Born 1764 in Paignton Devon. He married Susanna Hurrell in 1789 and had two children. Susanna died in 1795. He joined the Royal Navy in 1798. His will then left everything to his brother samuel. He went on to serve on HMS Temeraire and the will for 1805 left everything to his wife Jane. I cannot seem to find a marriage which I assume would have been between 1798 and 1805 Any help would be great. Thanks
