Still having trouble with the letting office.After the evil devious future m/i/l moved into the flat that we had put the deposit up for daughter and her boyfriend,we are no nearer to getting the £750 back.Daughter moved out 29th nov and gave 2 months notice to end the tenancy after 6 months instead of the year.(in the tenancy agreement)Had e-mail from letting office tenancy ends 10th feb.Waited no communication.Phoned them and e-mailed them.Told her ex partner had paid another deposit and would have to wait till his cheque cleared and his mother referenced.New date 11th March.Still no communication.E-mailed them again and gave them 7 days to give us our money back.They chose to ignore this.Wrote off to the Tenancy Deposit Scheme who took it up.Had letter back yesterday they could do nothing as the tenancy had not ended.That letting office now has 2 deposits and the ex has not signed a new tenancy.Have got to pay out for a solicitor now.God knows where we all stand.All i know is that the future evil m/i/l is laughing at us. I did reply to your original posting on this matter Grannie, as my Hubby with 30yrs experience and Head of Housing for a Housing Company, could have advised you, but you did not reply.
Your Daughter really needs to get down to the Company concerned and ask to see the Manager and fully explain her problem in person.

i am presuming you paid the deposit out of the kindness of your heart, to help your Daughter. The Company may not know this, and not want to deal with you. All they are interested in is that the deposit has been paid, no matter who provided it.
It really does sound as if the 'Tenancy' has just been renewed and hopefully you Daughter's name has been taken off the new agreement.
To be honest, none of this sounds right, dates you have posted differ slightly since you last posted.

Jenny.Sorry if i have sounded rude to you.We thought we would give them the benifit of the doubt.My dates are still the same.Daughter came home 29th nov and gave 2 months notice on the 11th dec with the keys.Have e-mail to say her tenancy will end 10th feb.but then it says if ex has moved out or paid another deposit.Ex was late paying a deposit so was told the new date would have to be 11th March so they can be cleared.On Tenancy agreement says after 4 months either party can give 2 months notice to end tenancy?Daughter gave the right notice. I'd say your daughter needs to send (or at least sign) a correctly worded letter and it needs to be sent by recorded mail, asking for a responce within so many days, I find emails and phones calls can be easily ignored much harder for them to brush off/deny recieving a recorded letter, a hunt on the net should bring up some advice, I know shelter had some advice on getting deposits back, before paying out for a solicitior.

If I were you I would take up the offer of help from Mommylonglegs, as her hubby will know what needs to be done to light a fire under their backsides.

It took us over three months to see our deposit back, although it wasn't in a protected scheme, also there was no complication with someone 'taking over' the tenacy, but bad letting agencys will drag their heels refunding, took us sending a letter stating something along the lines of 'we will be taking the appropriate legal action' to get a reaction, we'd have only dragged them to the small claims court and you don't need a solicitor for that.
