You can call yourself any name as long as it not for fraudulent purpose
I expect they grew up knowing Mr Smith was their dad and were known as Smith

ok but what I am saying is these 2 got married under a false name in the 1950's and 1960's without any proof of who they are.....

well as the mum was still married to Mr Pearson then that was still her surname so any child would be registered as such . even if she lived with Mr Smith if he isnt named as the father on the cert then it would only be in the name of Pearson although MR Pearson wouldnt be named as the dad

My father had the name Pearson put on his birth certificate as thats who my grandmother was married to at the time but he had left her and she started living with Smith. When my dad married he used the name SMith. He couldnt have been asked for proof of his name as his birth certificate definately has Pearson on it. When he died mum had to register his death as Pearson - Smith because the registrar questioned it. Just been browsing at the updated version of freebmd and found my dads brother who is 7 years younger than him is also registered under Pearson but he is definately a smith and is also married under the name smith. My grandmother refused to divorce pearson but surely she should have put smith on their birth certificates. They have a younger sister as well but her names not up there yet.
