Copyright-old photos

Hi There
Something just cropped up regarding some old photos I have in my collection, they are of family, given to me either the actual photos e-mailed to me by other extended family members.

Now most of these pictures are old wedding photos from the 1930's and 1940's (my Aunts and Uncles) and I am in particular refering to people that are now dead.

Am I in any breach of any copywight laws if I pass them on to others or display them on GR or any other website.
NOTE: NOT for any financial gain just for others to see.
I would NEVER put a picture of a living person on a website or GR without specific permission, so what about dead people??? Am I in breach of any laws??

My son says there is a "70 year" law or something but not sure how that applies to me?

Just wondered if anyone has had any dealings with this subject??

I think the copyright might lie with the original person who took the photos.

Personal feeling is that you are unlikely to have a problem, but if the original photographer is still alive I think it would be politic to ask them. If not, maybe the next of kin of the person just to be clear. You may have more of a problem if they were taken by an official photographer in which case if you google the name you might find out who to ask.

I don't really anticipate any problem, most of the pictures are done by a profesional photographer, some have the name of the photographer on them but most don't. I was worried that particularly with very distant cousins if I put a photo on and maybe that (dead) persons son or grandson or whatever saw them they might take offence-especially if they did not give me the picture in the first place.

I think I might feel a bit miffed if I suddenly saw a picture on a website (not paticularly GR) of my parents??

Maybe I am just thinking too much, as I say I would never put a picture of a living relative on a public tree, I know others do, possibly with or without permission from the person in question.

Anyway Ann, maybe I am just thinking too much!!!!!

I was going to c & P this, but there is masses of it!! I also think that this has been *tweaked* a bit since... and if you have a family photograph given, then if there is no sign of the negative, and you have an original, then it has been passed to you and you may use it (Not living relatives!! but those who have died,)

If you have the negative, then copyright is deemed to be yours.
