I was hit from behind when the car behind me was also struck by a car turning round a corner. Both myself (I had a tear in shoulder and whiplash)and the 'middle' car driver claimed from the person who started the chain-reaction. And won. Good luck, hope your daughter is OK. mary

Sandra We had a similar happen to us. The police were called and we were even told that we might be prosecuted for driving without due care and attention!!
However at the end of the day this didn't happen as it wasn't our fault. Our insurance company claimed on our behalf against the driver who ran into us (on his phone) and they also claimed against him for the damage to the car in front and we didn't have to pay anything and didn't loose our no claims bonus. He tried to say that we had hit the car in front then bounced back into his car!! As I say our insurance sorted everything for us. Lets hope your daughters will do the same for her. Do make sure you claim for your injuries as you may find that you need physiotherapy. Take care Von

The claim will be because your daughter must have been stationary without the handbreak on,,,,,its always been policy that you run into the back of a car then its classed as undue care and attention,,,,,,,,!! daft init........
the police should have been called as this woman *could* have had drink in her system!!!even if it couldnt be smelt......its too late now for a breathtest on her,,,,,,

Hope your daughter is feeling okay now Sandra.
It does seem very unfair when you're involved in an accident due to another's carelessness.
Last year our car was stationary on the road outside our house, we weren't in it! ...then it was hit by a moving car,causing serious damage to our car and a lot of iinconvenience. We of course made a claim against other driver, a claimant doesn't (or shouldn't) have to pay any costs,well in our case we didn't.
The maddening part for us now is that we have just applied for new insurance and told it has gone up £60.When we queried cost we were told 'you were in an accident',!? and if we now changed to another broker we would still have to declare the fact as it is now written on the contract.
Very unfair.... but thankfully for us nobody was injured.

It's not fair at all I agree.
My stationary and legally parked car was written off by a lorry whilst it was parked outside the school...no number plates on the lorry..so untraceable I had to pay the £300 excess and lose my full no claims bonus...I was fuming. To add insult to injury the police said I had to be breathalised at the *scene* FFS !!! Despite not even being IN the car at the time of the accident !!!
The system is ridiculous...
Main thing is though...over and above the understandable anger...no one is seriously hurt.
Hope its sorted very soon x

I still think you should inform the police in case there are any developments from the whiplash later when you'd need to claim damages.

Hi Sandra
This happened to us and they told us we would have to pay for hitting the car in front. We told them no way. We were pushed into the car in front, which was waiting to turn right, we were behind them, unable to move until they had turned. A person not paying attention crashed into our car pushing us into the one in front, we were also hit a second time by a driver behind the one who hit us. The insurance company of the person who hit us said it was a separate claim and it was up to us to sort the car in front out on our insurance. Totally outrageous. Anyway to cut a long story short, we stood our ground and we did not claim on our insurance. The accident would not have happened if the car had not hit us, so how on earth could it be our fault. That day, I came within an inch of being dead (I was in the back seat and the car had squashed right up to me - lucky we were in my husbands car (long boot) and not mine. To tell us we were responsible was the final insult. We won our point, so stand your ground. Life is so unfair isn't it.

So glad to hear your grandson is OK, and can truly sympathise with your anger. If you were injured, the police should have been called, but presumably you didn't realise you had whiplash until later.
The lead woman was only doing (in claiming from your daughter) what she has to, even though it doesn't seem fair. There is a chance that she will claim for personal injury/loss of earnings from your daughter, just as you and your daughter could off the rear driver.
She probably beetled off in shock, and wasn't thinking about the road worthiness! My brakes failed once, but I wasn't going fast and was able to steer into a side road and cruise to a halt. The brakes worked again immediately afterwards; the garage thought it might have been a bit of dirt in the brake hose thingy as they couldn't find any thing wrong.

Hi Sandra,
As there was personal injury involved the matter must be reported to police. Your daughter should go to a police station today and report it. Also allege that the driver that ran into the back of your daughter's car was driving a defect vehicle (brakes) on her own admission.

When out on Wed with my daughter and 20 moonth old grandson Daugher stop at the lights, a car came round the corner and ran into the back of her car, daughter car ran into the back of the car in front. We all get out of the cars and the woman who ran into my daughter all she can say it my brakes did not work. After everyone did what we have to do, this women gets back in her car and drove home, if her brakes did not work why did she drive that car home. Daughter car and the woman in the car in front are off the road. The women in the front car and my daughter are off work. We all 3 get whiplash grandson ok car seat no good now. The woman who caused this has told her insassurance company it was her fault, but now my daughter been told the woman who car she when into will claim on my her insassurance and she will loss her noclaims it is not fair when it was not her fault. The women we when into lives in my village and has phone to check that my grandson ok, the women who fault it was has not. Sorry i am just so mad with this women Sandy
