Theophila Kirkpatrick was my mother's paternal grandmother and I can not find a record of her birth but we have it from family records.

Theophila's sister, Elizabeth, married in 1884 to John Garrock Beddie b1861-d1944 (brother of Theophila's husband, William Beddie).

I know that Thomas Kirkpatrick arrived with assisted passage to Australia on the 'Formosa' on 28 May 1838 with wife, Helen/Ellen Dunnage (and a child - John??)

I have plenty of names and dates to add to the tree now - thank you

I think I have worked this out...
The deceased person and his disputed will refers to Adam Brown Kirkpatrick who died 22 Jun 1908 age 87yrs. He was the 5th son of Robert Kilpatrick of Closeburn, Dumfries.
He appears to be unmarried.

Unless my maths is out (again) the deceased was the brother of Thomas who emigrated in 1839.
It looks like his nieces and nephews are seeking their right as beneficiaries, but I am not sure if all of them are Thomas's kids?
Were there other children of Robert Kirkpatrick and Janet Hunter in Australia?

Roger Hunter Kirkpatrick seems to be the son of John Hunter Kilpatrick.... I wonder if John Hunter Kilpatrick was the son of Thomas ( b 1810) , or am I right to suspect that he is another brother born in Dumfries?

Following on from the above article about the estate, there was a decision reached a few days later. Summary:

"His Honor, in giving judgment, held, after reviewing the facts and authorities bearing on the questions at issue, that the estate must be divided into four parts - one for the executors of J. H. Kirkpatrick, one for the children or issue of Thomas Kirkpatrick, one for the children or issue of Robert Kirkpatrick, and one for the children or issue of Mrs. Twaddell; costs to come out of the estate."

Not too sure that the above two posts are about the same lady that Megan is researching but will leave in case they are connected.

If it's the correct one then she's mentioned in this article from the Sydney Morning Herald Saturday 11 May 1912 :

Mr. E. M. Betts, instructed by Messrs. Pyle and Westgarth, Blayney, by their agents, Messrs. Weaver and Allworth, appeared for the plaintiffs; Mr. Coffey, instructed by Messrs. Reid and Reid, for the defendants, R. H. Kirkpatrick and J. Stephen; Mr. Hinton, instructed by Messrs. Pyle and Westgarth, for Mrs. Beddie; Mr. Bonney, instructed by Messrs. Pyle and Westgarth, for A. D. Kirkpatrick; Mr. Wickham, instructed by Messrs. Pyle and Westgarth, for J. L. Whitmill; and Mr. Murray-Prior, instructed by Messrs. Pyle and Westgarth, for Miss Twaddell.

The plaintiffs were Campbell Ferguson and James Delahunt Matthews; and the defendants Roger Hunter Kirkpatrick, station manager, Buckungong; James Stephen, bank manager, Albury; Theophila Jane Beddie, Shaw; Archibald David Kirkpatrick, tramway employee, Newtown; John Loudon Whitmill, grocer, Parkes; and Jane Twaddell, Forbes.

This was an originating summons in which interpretation of the will of the late Adam Kirkpatrick, storekeeper, Blayney, was sought, the plaintiffs claiming to be the surviving executors, and the defendants claiming to represent the beneficiaries under the will.

It was set out that the testator died on June 18, 1908, and by his will of February 4, 1896, and a codicil of January 7, 1903, bequeathed his property, after payment of debts, to his brothers and sisters in equal shares. If any of them predeceased him their children were to inherit their parent's share. He directed that the children of two of his deceased brothers should inherit as heirs of their fathers. It was stated that the claims of a large number of relatives were involved. The Court was asked how the estate was to be apportioned. The amount involved was estimated at about £350.

His Honor reserved his decision.

It looks like it says daughter of John Dunnage...Gardener and janet... needlewoman

Theophila may have been born in Australia. DOB 17/02/1853

Her parents are Thomas Kirkpatrick and Helen Dunnage.
