Just had a thought!! Did you get in touch with Trading standards. They will know if you can claim.Trouble is,will the person you bought it from still be there or has he done a bunk?Sounds dodgy to me.Ask for advice before doing anything.

Just talking to OH about this and he said, did you inform the police as he'd seen on TV that a lot of caravans had been stolen and they were chasing up leads to find the travellers who were selling them.I do think the police should be told.Pity you scrapped it as it usually takes an independant assessor to see the damage.Explain everything to CAB and see what they advise.
good luck.

Hi Lorraine,
We have just had a case go through the small claims court.
firstly..I don't think you should have anything done to your caravan or destroyed because it may have to be inspected for evidence.
Ours was a dispute with autoglass who replaced our car windscreen 3 years ago and during the very wet weather it leaked into the electronic box and we had to have new locks etc on the car.
The autoglass chap checked it,put in a new windscreen and said the leak hadn't come from there.
however my OH(an ex PC) sent me to our local court where I got the forms and booklet and we had to pay £65 as it was over £500(up to that I think it was £40).We sent them in and you have to take them back to the court to be stamped and then wait 2 weeks for them to pay up.If they don't reply within that time they are liable.Ours replied at the last minute to say they were contesting it. A couple of hours later we had a call from autoglass to say who shall we make the cheque out to.
It doesn't mean you have to actually go to court. They also give you back the fee if you win your claim.
Make sure you have all your receipts.
hope this helps.

+++DetEcTive+++ Report 24 Mar 2010 15:52

The advice we were given, was to write to the person concerned saying that unless they refunded within 28 days of the date of the letter, we would be taking them to the Small Claims Court and would be adding the court costs and interest of X% to the amount claimed. Then send the letter by recorded/signed for delivery.

The threat of being taken to Court often makes them pay up before you actually have to put in the paper work: we never got that far.

You really do need legal advice in your case (CAB or free' 30 mins from a solicitor) , as it isn't clear cut. But no harm in trying it on as suggested above.

StrayKitten Report 24 Mar 2010 15:52

puss, the CAB are fantastic and will do eveything for you if they can help xxx

Merlin

Merlin Report 24 Mar 2010 15:50

Pusscat, you should be able to go to the CAB or your local court, ask at the desk ,they will give you the information you require, and cost, then proceed as you wish. Its not an open court,it quite civilised and private, but consider what was said earlier, would it be worth it? also go and see a restorer and get a Quote for putting the Van right, Either way you can tell the court the cost of repair ,or ,have it done. Take care., **M**.

TeresaW Report 24 Mar 2010 15:41

I agree with Muffy, you really need to speak to the CAB first, they will give you the legal advice you need to see if it's worth going through the small claims courts.

Please puss, find out about it first, don't fill that in any further until you have.

Muffyxx

Muffyxx Report 24 Mar 2010 15:39

Puss...i don't know a thing about small claims...

have you been in touch with the CAB or anything hon? I personally wouldn't part with anymore cash until I had some professional advice first x
