Thanks. That is very helpful and goes a long way to explain Julia's difficulties. It does say discretion of the registrar could come into it so it is her bad luck to get one who does not want to exercise theirs. She is of course hoping to find descendants.

+++DetEcTive+++ Report 12 Oct 2015 23:19

His sister might be able to apply.

Sibling may only make application where the registered person has no surviving spouse, children or parents or where they were the informant for the death registration; and

Proof of Identity of applicant as per the Proof of Identity requirements; and

Reason for access must be stated i.e. must be acting for person entitled to information or certificate and required either for production in Court; for lodgement with the Registrar of Titles, or for administration of an estate
............

If you've applied, you may be considered as an Agent under the clause
Any person with the written authority of an eligible applicant or with Power of Attorney (i.e. family member not eligible via family access, ....)

You need to supply or state
Proof of Identity of applicant as per the Proof of Identity requirements; and

Written authority from and Proof of Identity of the registered person or other eligible applicant, or Power of Attorney document to be produced and;

Reason for access must be stated i.e. must be acting for person entitled to information or certificate and required either for production in Court; for lodgement with the Registrar of Titles, or for administration of an estate
...
At the beginining of the doc, it does state that
The Registrar’s discretion in deciding entitlement to information or certificates is not exhausted by this policy. Decisions may be made by the Registrar-General on any unusual case that may fall outside the scope of this policy.
.........

+++DetEcTive+++

+++DetEcTive+++ Report 12 Oct 2015 23:13

There is a download re the State’s Access Policy from here
http://tiny.cc/uuqm4x

From a quick scan,
......
The age of the entry
Recognising that the sensitivity of personal information and the chances of its fraudulent use diminish with time, the Registrar allows unrestricted access to certificates and indexes of:

Birth – Open access after 100 years

Death – Open access after 30 years <<<<<<<

Marriage – Open access after 75 years

Content of the records dictates to what degree the applicant’s relationship to the registered person will apply. The more sensitive the information on the records, the greater the restrictions on access.
Death information or certificates pose less potential for invasion of privacy and fraudulent use, therefore access to this information or certificates is less restrictive. (than birth or marriage certificates)

Thanks Kay. Is it because the death is relatively recent? I sent for my grandfather's death cert last year. He died in Sydney in 1966. I did not have to produce any proof of my identity. A sign of the times I suppose.

Jennifer its not strange at all,as they need proof she is who she says she is,also they are strict on ID theft for underhand dealings......its GOV after all and have rules in place that they have to adhere to.plus her passport details arent at risk if they are not being sent by unproteced post.

Thanks for the info. However Julia is dealing with that gov. department and they are being obstructive and want her passport details etc. It sounds so strange.

It now seems that David Guthrie died in Brisbane Australia in 2004. The Brisbane authorities are not letting DAvid's sister Julian Stevens,m order his death certificate. Does anybody know what the rules are in Brisbane for ordering death certs please? I have never had trouble in getting them for Sydney area deaths.
Apparent Julia has learned that David was not married at the time of his death and had no children so she as his sister is his next of kin his parents both being dead.
ASny advice please.

Julia story mentions that one lady said that she remembers in 1965 working in a penguin book shop with a lady called Christine whose boyfriend deserted from the navy.I have found a David Guthrie reg on a Australia Electoral Roll in 1980 who looks like he is married to a Euphamia Christina Guthrie

Odd as it may seem, it is how this website operates.

Perhaps Facebook and the Daily Mail are not the standard to aim for.

Thanks for your concern.

Carrie did edit out the personal info in question in this thread.

Daily Mail, published yesterday ... 'I realised that I know nothing about my brother, so I went online and found the documents from the Australian government ...'

how clever of Julia to do that all by herself (and not mention it in her 'Facebook plea') ... or did she ...?

Lawrence Report 27 May 2015 21:07

I see that the info on DOB & personal history is on a Facebook post 'Call Yersel a BANKIE in Australia'. It is a public group. Seems odd to be permitted on FB but not on GR.

Note also on this Daily Mail that there is a photo of the lad when he was in his teens.

JoonieCloonie Report 24 May 2015 15:32

Hi Carrie, I'd be rather surprised if google would find the document you cited just by searching for the individual's name with whatever details ... I'd have thought a search would have to be done at the site itself but I could be wrong

... since the info you have posted is copied from handwritten/scanned documents that google would not read ... (not even googling the name with the dob shown in that record finds it)

this board has its own rules about posting intrusive personal details about someone without their knowledge though, and yes, that is what the private messaging system is for :-)

actually your post starting 'Hi there! I am in Australia' still contains all the details I referred to as being intrusive ... it was the actual personal history, not the dates, to which I referred ... the individual or his family really just might not want that personal background displayed like this on line, don't you think?

Thanks for all your help Carrie. You obviously know your stuff!

Jennifer I have edited posts I previously put up and have sent you a personal unedited copy. All further correspondence I will inbox you. In regards to your post Joonie, not trying to be nasty but just stating that this immigration information is already publicly available as Google is exactly how I came across these details, although I did do a little more digging, however after a certain period of time here in Australia records are opened up to the public by the Australian Government.

JoonieCloonie

JoonieCloonie Report 23 May 2015 02:23

Jennifer I had checked out death notices in the background when I read your post first

http://ryersonindex.net/search.php

there are several references to the death being published in the Geelong Advertiser but this one

GUTHRIE David John
Death notice 13OCT2009
Death (age) 54
Geelong Advertiser 19OCT2009

suggests it is not him I think? dob 1946 would have made him 63 in 2009

I'm somewhat concerned about all the personal info in the post by Carrie ... the person or his family might not want these details of his personal history displayed on the internet where search engines find them ... google finds this thread now on a simply search for his name and 'Australia' ... editing those details out now that Jennifer has seen them would seem wise

jenVG Report 22 May 2015 11:00

We have learnt of a death notice in Geelong Advertiser Oct 2009 which may be him so that is being followed up on as I write. Hopefully it will be a different David Guthrie.Thanks to all.

That is him! His sister thought it possible was was using his mum's maiden name of White - possibly because of the desertion?
How can his sister see that information on Dept of Immigration?
Thanks
