Also, Erika H in 1881, Peter's wife and child were living with her parents William and Mary Mitchell at the same address as listed on her marriage certificate to Peter. She is still listed as married at this time and Martha is 4 years old (1881 Census). That's very interesting your finding the listing for another child - and I agree, it's very likely that this is Martha's sister and that Peter was, therefore, still alive in 1893. There's so much information to work through - so thank you everybody!

It will certainly be interesting to see what Martha's birth certificate brings. Either Peter was the father and was away at sea not realising that Mary was pregnant or as Erika has said, he wasn't the father. Having said that, he was taking her on with a babe in arms when he married her in December 1879 and I wonder how many men would have been prepared to do that if the child wasn't theirs.

It is indeed a bit weird that Mary goes by her maiden name in the 1881 census despite being married to Peter and also presumably possibly being pregnant with her second child.

I'm not sure about the listing on the Census in 1871 which gives Peter as from Falkirk as it says he's a farm servant. His signature is that of an educated person - very flowing and confident plus his father is an Engineer so a professional person and in 1871 it would have been a big jump for his dad to go from being a Labourer to an Engineer (very confusing - I had found this listing myself and until I received the marriage certificate thought it was the most likely one).

Fascinating the court appearance. I shall have to have a closer look at that. Sorry also re the mis-type on my part - it is indeed Mary Elizabeth, not Margaret Elizabeth.

Hi Erika - I don't want to give up on the McKinnon link just yet as I had my daughter when I was unmarried and her dad and I only got round to putting his name on her birth certificate when she was about fifteen! I probably need to find out how long Peter might have been away for as my dad (who was a Captain at sea so there's possible a seafaring gene there) used to be away for about eighteen months at a time when I was a child. It's certainly a puzzle.

I think Mary's being recorded by the maiden name in 1881 is probably down to an error on the part of the enumerator - perhaps copying incorrectly from the indivdual sheets to the census page

I'll be surprised if a father is named on Martha's birth cert - but I hope for your sake that the info is recorded

A baptism record might be more informative

Yes, good point about Peter's father's occupation although again, to see such beautiful handwriting suggests to me that he was well educated.

Sorry to play devil's advocate, but, as things stand, there is no proof that Peter's father was John Mckinnon

He named him when he married, but I'm assuming that he wasn't a witness to the marriage, or I think you'd have mentioned it.

As for Martha's birth cert - for the father to be named, he would have had to be present, and there would have been two entries on the GRO register - one in each surname.

There are no Peter Mc/MacKinnons born in Scotland 1851-1854 with father's name John, per SP.

EDIT:
The only one 1845-54 is the Snizort one - but I don't think he's the right one.
