There was a thread about this a while back.... I was convinced it was against the law.... however.... to spit AT someone is not, I don't think, against the law.... but for someone to spit at someone, and it actually hits that someone, then it becomes an assault.

And with so many illnesses spread easily from spit, I think it should be a criminal offence to spit anywhere out in the public! It is one of the most offensive things I see on a day to day basis!!

People spit and hawk all over the pavement.... and kiddies walk through it in their shoes..... it gets all over pram and pushchair wheels, and into homes where little ones should be safe to walk and crawl around on their own floors!

ps.... why is it that most men find it ok to spit? And it seems it is ok for a boy to spit, but not for a girl? Grrrrrrrrrr!! xxxxx

If someone spat at me,and it landed on me, after giving them a good -pasting, (well in theory), I would try to be tested for contamination by bodily flueds. What about people that have a low immune system etc.

Also kiddies can fall down in it and dogs bring it in the house on their paws. Years ago you would see signs up saying No Spitting. Footballers don't set a very good example on the pitch do they. Boys copy them.

If it is not an offence it should be. By us if you are not dodging dog muck it is flem filled spit, yuck! I have to tell my son keep your eyes to the floor so you don't stand in something.
I am not violent but if someone spat on me I think I would knock their disgusting head off!

From a Times article:

Spitting on someone is an offence. But spitting at someone is not, if the spit lands merely on the pavement. There is no piece of legislation that deals specifically with spitting. True, a fixed penalty notice of £100 from the police for loutish behaviour may follow a spitting incident. But how many of those are there likely to be? How many police will catch people in the act?

A bloody good club around their ear with a baseball bat would be a better deterrent.

During the Beijing Olympics, the locals were encouraged by the authorities to desist from spitting in public - a common occurrence in that region.

Eldrick Report 17 Aug 2009 17:49

No, it's not an offence per se. At the most, common assault (CJA s 39) but unless you could prove injury, it would go nowhere.

It would all depend on the circumstances surrounding the incident as to whether it could be considered a breach of one of the public order acts.
